SOME STEPS TOWARDS MARKET UNITY

Law 20/2013, of 9 December, Guaranteeing Market Unity, entered into force this month in order to overcome the piecemeal legislation regarding the requirements to be met by the companies operating in Spain, which were until now set forth in the corresponding commercial regulations of each autonomous community.

Among others, the abovementioned Law provides the following measures with the objective of achieving a better framework for competition and investment (and, in turn, a higher degree of legal certainty): (i) the establishment of a single commercial license for the whole country; (ii) the creation of the Council for Market Unity (a collaboration organ between various public bodies in order to ensure the aforesaid objective); and (iii) the implementation of a procedure with the National Markets and Antitrust Commission to be initiated by any particular in the event of administrative decisions that jeopardize or prevent the free circulation of goods and services (*).
