{"id":596,"date":"2014-01-10T13:09:23","date_gmt":"2014-01-10T11:09:23","guid":{"rendered":"http:\/\/www.fabregat-perulles-sales.com\/actualidad\/?p=596"},"modified":"2014-11-26T14:50:04","modified_gmt":"2014-11-26T12:50:04","slug":"unwirksamkeit-von-klauseln-zum-mindestzinssatz","status":"publish","type":"post","link":"https:\/\/www.fabregat-perulles-sales.com\/actualidad\/unwirksamkeit-von-klauseln-zum-mindestzinssatz\/","title":{"rendered":"Unwirksamkeit von Klauseln zum Mindestzinssatz"},"content":{"rendered":"<p>Die Festlegung eines Mindestzinssatzes mitteils einer Klausel in Kreditvertr\u00e4gen (sog. <b><i>cl\u00e1usula suelo<\/i><\/b>) ist in Spanien derzeit h\u00e4ufiger Gegenstand von gerichtlichen Entscheidungen, die die Wirksamkeit entsprechender Vertragsklauseln n\u00e4her definieren.<\/p>\n<p>Die diesbez\u00fcgliche Grundsatzentscheidung des <a href=\"http:\/\/www.poderjudicial.es\/stfls\/SALA%20DE%20PRENSA\/NOVEDADES\/Auto-Cl%C3%A1usulas%20suelo-Incidente%20de%20Nulidad.pdf\" target=\"_blank\">Tribunal Supremo<\/a> (Oberster Spanischer Zivilgerichtshof) vom 06. November 2013<strong> <\/strong>zur Frage der <b>Transparenz einer Klausel zum Mindestzinssatz <\/b>und der <b>unangemessenen Benachteiligung<\/b> des Kreditnehmers wurde erst k\u00fcrzlich in einem Berufungsbeschluss (Audiencia Provincial von \u00c1lava, Beschluss v. 09.12.2013, AZ: 196\/2013) erneut aufgegriffen. Der Beschluss der zweiten Instanz bezieht sich auf den Widerspruch gegen die Vollstreckung aus einer Hypothek (<i>ejecuci\u00f3n hipotecaria<\/i>) gem. <a href=\"http:\/\/noticias.juridicas.com\/base_datos\/Privado\/l1-2000.l3t4.html\" target=\"_blank\">Art. 695 I Nr. 4 LEC (Ley 1\/2000 de Enjuiciamiento Civil)<\/a>, dem mit dem Hinweis stattgegeben wurde, die Klausel mit Festlegung einer unteren Grenze zum Zinssatz des Kredits f\u00fchre zu einer unangemessenen Benachteiligung.<\/p>\n<p>Die Berufung dagegen hatte keinen Erfolg, wobei auf folgende <b>Vorgaben des Tribunal Supremo<\/b> zur <b>Unwirksamkeit<\/b> der Klausel verwiesen wurde:<\/p>\n<p><!--more--><\/p>\n<p>a) Sofern der Vertrag u.a. in seiner Gesamtheit der Struktur Allgemeiner Gesch\u00e4ftsbedingungen folgt, ist das <a href=\"https:\/\/www.boe.es\/diario_boe\/txt.php?id=BOE-A-1998-8789\" target=\"_blank\">Gesetz 7\/1998<\/a>\u00a0 zum Vertragsschluss anzuwenden.<\/p>\n<p>b) Die blo\u00dfe einseitige Festlegung des Zinssatzes durch den Verwender f\u00fchrt allein noch nicht zur Rechtswidrigkeit der Klausel.<\/p>\n<p>c) Die Funktion der angesprochenen Klausel liegt in der Vermeidung von Zins\u00e4nderungen laut der Spanischen Staatsbank. Vor diesem Hintergrund gilt es, sie u.a. daraufhin zu \u00fcberpr\u00fcfen,<\/p>\n<ul>\n<li>ob der Verbraucher nicht erkennen konnte, dass der Hauptgegenstand des Vertrages durch sie mitbestimmt wird;<\/li>\n<\/ul>\n<ul>\n<li>der Verbraucher nicht aufkl\u00e4rt wurde, dass es sich um einen Kredit mit <i>teilweise<\/i> <i>festem<\/i> Zinssatz handelt, der nur der H\u00f6he nach variabel ist sowie<\/li>\n<li>ein Missverh\u00e4ltnis zwischen den Interessen des Kreditnehmers- und gebers besteht.<\/li>\n<\/ul>\n<p>Sofern der Kreditvertrag den <b>Anschein<\/b> erweckt, der <b>Zinssatz sei variabel<\/b>, obwohl in Wirklichkeit die Bestimmung des Mindestzinssatzes einen Festzins mit alleiniger M\u00f6glichkeit der Erh\u00f6hung vorsieht, ist die Klausel sowohl intransparent als auch rechtsmissbr\u00e4uchlich. Sie kann so einen Widerspruch gegen die Vollstreckung aus einer Hypothek nach Art. 695 I Nr. 4 LEC begr\u00fcnden.<\/p>\n<p>Bei der Formulierung der Klausel zum Mindestzinssatz und Information des
