Dezember 2012 wurde im <i>Bolet\u00edn Oficial del Estado<\/i> (Gesetzblatt) das <a href=\"http:\/\/www.boe.es\/diario_boe\/txt.php?id=BOE-A-2012-6929\" target=\"_blank\">Gesetz 12\/2012 vom 26. Dezember zu Eilma\u00dfnahmen f\u00fcr die Liberalisierung des Einzelhandels und bestimmter Dienstleistungen verk\u00fcndet<\/a>. Dieses Gesetz schafft das Erfordernis der Genehmigungserteilung vor Er\u00f6ffnung der Gesch\u00e4ftsr\u00e4ume oder Beginn der Aktivit\u00e4t bez\u00fcglich all derjenigen Aktivit\u00e4ten ab, die in seinem Anhang aufgef\u00fchrt sind (v.a. Einzelhandel, aber auch bestimmte Dienstleistungen sowie Bereiche aus dem Handwerk, wie die Produktion von handgefertigten Schuhen), sofern diese Aktivit\u00e4t auf einer \u00f6ffentlichen Ausstellungs- und Verkaufsfl\u00e4che von nicht mehr als 300 m2 ausge\u00fcbt wird. Die vorgelagerte Genehmigung wird bei Erf\u00fcllung dieser Voraussetzungen \u2013 au\u00dfer bei Auswirkungen auf das nationale Kulturgut oder auf \u00f6ffentliches Eigentum \u2013 durch Erkl\u00e4rungen der zust\u00e4ndigen Stelle oder vorherige Mitteilungen ersetzt. Hervorzuheben ist, dass dieses Gesetz allgemein verbindlich ist, d.h. auch f\u00fcr die Verwaltung der autonomen Regionen. Bei Versto\u00df sieht das Gesetz die Nichtigkeit des Verwaltungshandelns und die M\u00f6glichkeit der Staatshaftung der betreffenden Verwaltungsbeh\u00f6rde vor. Daneben stellt das Gesetz lediglich den Mindestumfang fest, so dass die Verwaltungsbeh\u00f6rden den Anwendungsbereich f\u00fcr die Aufhebung der Voraussetzung einer vorgelagerten Genehmigung auch
