El resultado de la votaci\u00f3n fue de 103 votos a favor de su convalidaci\u00f3n, por los 243 en contra.<\/p>\n<p><!--more--><\/p>\n<p><img decoding=\"async\" loading=\"lazy\" class=\" wp-image-3713 alignright\" src=\"http:\/\/www.fabregat-perulles-sales.com\/actualidad\/wp-content\/uploads\/2019\/01\/llaves-casa-no-convalidaci\u00f3n-LAU-abogados-espanol-1-300x200.jpeg\" alt=\"llaves, LAU, Decreto, convalidaci\u00f3n\" width=\"294\" height=\"196\" srcset=\"https:\/\/www.fabregat-perulles-sales.com\/actualidad\/wp-content\/uploads\/2019\/01\/llaves-casa-no-convalidaci\u00f3n-LAU-abogados-espanol-1-300x200.jpeg 300w, https:\/\/www.fabregat-perulles-sales.com\/actualidad\/wp-content\/uploads\/2019\/01\/llaves-casa-no-convalidaci\u00f3n-LAU-abogados-espanol-1-768x512.jpeg 768w, https:\/\/www.fabregat-perulles-sales.com\/actualidad\/wp-content\/uploads\/2019\/01\/llaves-casa-no-convalidaci\u00f3n-LAU-abogados-espanol-1-1024x683.jpeg 1024w, https:\/\/www.fabregat-perulles-sales.com\/actualidad\/wp-content\/uploads\/2019\/01\/llaves-casa-no-convalidaci\u00f3n-LAU-abogados-espanol-1-660x440.jpeg 660w\" sizes=\"(max-width: 294px) 100vw, 294px\" \/>La norma, que entr\u00f3 en vigor el 18 de diciembre de 2018, ha dejado de estar en vigor y, por tanto, queda sin efectos, a partir de hoy, jueves 24 de enero de 2019, d\u00eda en el que el resultado de la no convalidaci\u00f3n ha sido publicado en el BOE. As\u00ed las cosas, si bien el Real-Decreto Ley desaparece del ordenamiento, su no convalidaci\u00f3n no supone la anulaci\u00f3n de sus efectos durante el tiempo que \u00e9ste estuvo en vigor, siendo que los contratos celebrados entre el 18 de diciembre de 2018 y el 23 de enero de 2019 (ambos incluidos), est\u00e1n sometidos a lo que esta norma disponga.<\/p>\n<p>En consecuencia, la\u00a0<a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1994-26003&amp;tn=2\">Ley de Arrendamientos Urbanos\u00a0 (LAU) 29\/1994, de 24 de noviembre<\/a>, vuelve a su redactado previo, que esencialmente emana de la versi\u00f3n introducida mediante la <a href=\"https:\/\/www.boe.es\/buscar\/doc.php?id=BOE-A-2013-5941\">Ley 4\/2013, de\u00a0 de medidas de flexibilizaci\u00f3n y fomento del mercado de viviendas de alquiler, 4 de julio<\/a>.<\/p>\n<p>Concretamente, los efectos de la no convalidaci\u00f3n del Real-Decreto Ley 21\/2018 son los siguientes:<\/p>\n<ul>\n<li>Los pisos denominados tur\u00edsticos vuelven a estar contemplados directamente en la LAU, sin que queden sujetos a la normativa sectorial tur\u00edstica.<\/li>\n<li>El plazo de duraci\u00f3n m\u00ednima de los contratos de arrendamiento vuelve a ser de 3 a\u00f1os de duraci\u00f3n, y no 5 y 7 si el arrendador fuera persona jur\u00eddica, como preve\u00eda el Real-Decreto Ley (art\u00edculo 9.1).<\/li>\n<li>La pr\u00f3rroga obligatoria para el caso que el arrendador no remita la notificaci\u00f3n de la voluntad de no renovaci\u00f3n del contrato, llegada la fecha de su vencimiento, vuelve a ser de 1 a\u00f1o, y no de 3 (art\u00edculo 10.1).<\/li>\n<li>Se elimina el l\u00edmite al incremento de la renta conforme al \u00cdndice de Precios al Consumidor que se establec\u00eda para los contratos de arrendamiento de renta reducida (art\u00edculo 18.1).<\/li>\n<li>Queda suprimida la obligaci\u00f3n del arrendador, cuando \u00e9ste sea persona jur\u00eddica, de asumir los gastos de gesti\u00f3n inmobiliaria y formalizaci\u00f3n que se deriven del contrato (art\u00edculo 20.1).<\/li>\n<li>Se elimina el derecho de tanteo y retracto que el Real-Decreto Ley establec\u00eda respecto a la totalidad del inmueble en favor del \u00f3rgano que designe la Administraci\u00f3n, para los casos de venta conjunta de las viviendas de un mismo inmueble propiedad del arrendador o venta a un mismo comprador la totalidad de los pisos de un inmueble, contemplado en el apartado s\u00e9ptimo del art\u00edculo 25 de la LAU.<\/li>\n<\/ul>\n<p>Los otros textos que fueron modificados por el Real-Decreto Ley 21\/2018 y que, ahora, vuelven a sus versiones anteriores son: la\u00a0<a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1960-10906\">Ley 49\/1960, sobre propiedad horizontal, de 21 de julio<\/a>; la <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2000-323&amp;p=20151028&amp;tn=1\">Ley 1\/2000, de Enjuiciamiento Civil, de 7 de enero<\/a>; el <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2004-4214\">Real-Decreto Ley 2\/2004, de 5 de marzo, por el que se aprueba el texto refundido de Ley Reguladora de Haciendas Locales<\/a>; y el <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1993-25359\">Real Decreto Legislativo 1\/1993, de 24 de septiembre, por el que se aprueba el Texto refundido de la Ley del Impuesto sobre Transmisiones Patrimoniales y Actos Jur\u00eddicas Documentados<\/a>.<\/p>\n<p>Puede consultar <a
