en vigor en Espa\u00f1a la Ley Org\u00e1nica 3\/2018, de 5 de diciembre, de Protecci\u00f3n de Datos Personales y garant\u00eda de los derechos digitales (BOE n\u00fam. 294, de 06.12.18).\u00a0<\/strong><\/p>\n<p><!--more--><\/p>\n<p><img decoding=\"async\" loading=\"lazy\" class=\"alignright size-medium wp-image-3666\" src=\"http:\/\/www.fabregat-perulles-sales.com\/actualidad\/wp-content\/uploads\/2018\/12\/mesa-ordenador-proteccion-datos-abogados-espanol-300x159.jpg\" alt=\"protecci\u00f3n, datos, internet\" \/><\/p>\n<p>Esta nueva Ley Org\u00e1nica, que <strong>deroga la hasta ahora vigente Ley Org\u00e1nica 15\/1999<\/strong>, de 13 de diciembre, de Protecci\u00f3n de Datos de Car\u00e1cter Personal, con las salvedades previstas en la disposici\u00f3n adicional 14\u00aa y disposici\u00f3n transitoria 4\u00aa, tiene por <strong>objeto<\/strong>:<\/p>\n<p><strong>i) Adaptar el ordenamiento jur\u00eddico espa\u00f1ol al Reglamento (UE) 2016\/679<\/strong> del Parlamento Europeo y el Consejo, de 27 de abril de 2016, relativo a la protecci\u00f3n de las personas f\u00edsicas en lo que respecta al tratamiento de sus datos personales y a la libre circulaci\u00f3n de estos datos, y completar sus disposiciones, <strong>el cual ya viene siendo plenamente aplicable en nuestro pa\u00eds desde el pasado 25.05.18<\/strong>.<\/p>\n<p><strong>ii) Y garantizar los derechos digitales de la ciudadan\u00eda<\/strong> conforme al mandato establecido en el art\u00edculo 18.4 de la Constituci\u00f3n, <strong>regul\u00e1ndose en particular los<\/strong> <strong>derechos y libertades predicables al entorno de Internet<\/strong> como la neutralidad de la Red y el acceso universal o los derechos a la seguridad y educaci\u00f3n digital as\u00ed como los derechos al olvido, a la portabilidad y al testamento digital, ocupando un lugar relevante el reconocimiento del derecho a la desconexi\u00f3n digital en el marco del derecho a la intimidad en el uso de dispositivos digitales en el \u00e1mbito laboral y la protecci\u00f3n de los menores en internet, resultando tambi\u00e9n destacable la garant\u00eda de la libertad de expresi\u00f3n y el derecho a la aclaraci\u00f3n de informaciones en medios de comunicaci\u00f3n digitales.<\/p>\n<p>Pueden consultar el texto
