November 2016 dar\u00fcber entschieden, ob die Kosten der Telefoneinrichtungen an den Bautr\u00e4ger\/Konstrukteur r\u00fcckzahlbar sind. Sowie bereits im Urteil des Gerichts der ersten Instanz, weist die Audiencia Provincial auf die Notwendigkeit hin, zwischen zwei klar zu differenzierenden Handlungen zu unterscheiden: einerseits dem Erschlie\u00dfungsprojekt und andererseits dem sp\u00e4teren Bau des privaten Immobilienkomplexes. Das Erschlie\u00dfungsprojekt bezieht sich auf die Ma\u00dfnahmen auf erschlie\u00dfungsf\u00e4higem Gebiet. Durch diese Ma\u00dfnahmen wird das Gebiet im Rahmen der Ausf\u00fchrung der Stadtplanung erschlossen und erh\u00e4lt die Eigenschaft des st\u00e4dtischen Bodens. In diesem Prozess werden die sp\u00e4teren Grundst\u00fccke mit allen notwendigen Versorgungseinrichtungen versehen, damit sie die Eigenschaft des bebaubaren Bodens erhalten (Abwasserleitungen, Gehwege, Beleuchtung, Trinkwasser, Telefon), wobei die notwendige Infrastruktur der Versorgungsnetzwerke auf \u00f6ffentlichem Boden gelegt wird. Der sp\u00e4tere Bau des privaten Immobilienkomplexes weist eine andere Infrastruktur der unterirdischen Kanalisierung der Telefoneinrichtungen auf: die sogenannte \u201egemeinsame Infrastruktur\u201c, \u00fcber welche die Wohngeb\u00e4ude in ihrem Inneren verf\u00fcgen. Im ersten Fall bestehen keine Zweifel, so die Entscheidung, dass das galizische Gesetz zur st\u00e4dtischen Raumplanung und dem Schutz von l\u00e4ndlichen Gebieten (\u201eLey de Ordenaci\u00f3n Urban\u00edstica y Protecci\u00f3n del Medio Rural de Galicia\u201c) zur Anwendung kommt, welches festlegt, dass die Eigent\u00fcmer des erschlie\u00dfungsf\u00e4higen Bodens (in dem entschiedenen Fall, der Bautr\u00e4ger), das Recht auf R\u00fcckerstattung der Kosten der Anbringung der Versorgungsnetzwerke von den Unternehmen, die diese Versorgung anbieten,
