enero de 2017, se public\u00f3 en el Bolet\u00edn Oficial de las Cortes Generales, la <a href=\"http:\/\/www.congreso.es\/public_oficiales\/L12\/CONG\/BOCG\/B\/BOCG-12-B-78-1.PDF\" target=\"_blank\">Proposici\u00f3n de Ley<\/a> de modificaci\u00f3n de la <a href=\"http:\/\/noticias.juridicas.com\/base_datos\/Privado\/l1-2000.html\" target=\"_blank\">Ley 1\/2000, de 7 de enero, de Enjuiciamiento Civil<\/a>, por la que se regula un <strong><u>procedimiento espec\u00edfico para garantizar la posesi\u00f3n de viviendas titularidad de propietarios personas f\u00edsicas y para asegurar a las entidades sociales y a las administraciones p\u00fablicas la disponibilidad de las viviendas en su haber destinadas a alquiler social.<\/u><\/strong><\/p>\n<p>Dicha proposici\u00f3n trae causa de la reciente proliferaci\u00f3n de fen\u00f3menos de okupaci\u00f3n ilegal premeditada, que exige el pago de cantidades a cambio de un techo inmediato, o que extorsionan al propietario para obtener una compensaci\u00f3n econ\u00f3mica como condici\u00f3n para recuperar la vivienda de su propiedad.<\/p>\n<p><!--more--><\/p>\n<p>En efecto, si bien ya existen v\u00edas legales para proceder al desahucio de okupas \u2013p.ej. como delito de usurpaci\u00f3n; procedimiento de tutela sumaria de la posesi\u00f3n; el llamado \u201cdesahucio por precario\u201d, entre otros-, lo cierto es que no resultan del todo satisfactorias en la pr\u00e1ctica.<\/p>\n<p>Por todo ello, la Proposici\u00f3n de Ley sugiere la modificaci\u00f3n del art. 250.1 y 441 de la Ley de Enjuiciamiento Civil, a fin de a\u00f1adir la posibilidad de recuperar la posesi\u00f3n de una vivienda ocupada ilegalmente mediante el procedimiento de juicio verbal, posibilidad que podr\u00e1 ejercer el propietario persona f\u00edsica, as\u00ed como las entidades sociales y administraciones p\u00fablicas tenedoras de un parque de viviendas de car\u00e1cter social destinado a atender necesidades urgentes de personas y familias que se encuentran en situaci\u00f3n de vulnerabilidad en materia de vivienda.<\/p>\n<p>En caso de que llegue a aprobarse dicha Proposici\u00f3n, ello simplificar\u00eda los tr\u00e1mites para desahuciar a los okupas, y seguramente \u2013y esperemos que as\u00ed sea-, reducir\u00eda el plazo en el que los propietarios que cumplan las caracter\u00edsticas anteriores puedan
