{"id":1638,"date":"2014-12-26T20:40:54","date_gmt":"2014-12-26T18:40:54","guid":{"rendered":"http:\/\/www.fabregat-perulles-sales.com\/actualidad\/?p=1638"},"modified":"2015-01-02T20:44:26","modified_gmt":"2015-01-02T18:44:26","slug":"resolucion-de-los-contratos-de-arrendamiento-de-locales-de-renta-antigua","status":"publish","type":"post","link":"https:\/\/www.fabregat-perulles-sales.com\/actualidad\/resolucion-de-los-contratos-de-arrendamiento-de-locales-de-renta-antigua\/","title":{"rendered":"RESOLUCI\u00d3N DE LOS CONTRATOS DE ARRENDAMIENTO DE LOCALES \u201cDE RENTA ANTIGUA\u201d"},"content":{"rendered":"<p>El pr\u00f3ximo 1 de enero de 2015 se extinguir\u00e1n legalmente muchos contratos de arrendamiento de locales de negocio celebrados con anterioridad al 9 de mayo de 1985,\u00a0 conocidos como \u201ccontratos de renta antigua\u201d, que se beneficiaban de la pr\u00f3rroga forzosa prevista en el texto refundido de la <a href=\"http:\/\/noticias.juridicas.com\/base_datos\/Derogadas\/r0-d4104-1964.html\">Ley de Arrendamientos Urbanos de 1964<\/a>.<\/p>\n<p>El r\u00e9gimen legal de la pr\u00f3rroga forzosa de los contratos de arrendamiento urbano fue suprimido para los nuevos contratos celebrados a partir de la entrada en vigor del <a href=\"http:\/\/noticias.juridicas.com\/base_datos\/Fiscal\/rdl2-1985.html#a9\">Real Decreto-Ley 2\/1985<\/a>, de 30 de abril, sobre medidas de pol\u00edtica econ\u00f3mica (Decreto Boyer), subsistiendo los contratos de renta antigua en vigor en dicho momento.<\/p>\n<p><!--more--><\/p>\n<p>Con la adopci\u00f3n de la <a href=\"http:\/\/noticias.juridicas.com\/base_datos\/Privado\/l29-1994.html\">Ley 29\/1994, de 24 de noviembre de 1994<\/a>, de Arrendamientos Urbanos, se establecen los supuestos de extinci\u00f3n, en lo que aqu\u00ed interesa, de <b>los contratos de local de negocio celebrados antes del 9 de mayo de 1985<\/b> que se encontraban en situaci\u00f3n de pr\u00f3rroga legal en la fecha de su entrada en vigor, distinguiendo los siguientes casos:<\/p>\n<ul>\n<li>Los arrendamientos cuyo <b>arrendatario fuera una persona f\u00edsica<\/b> se extinguen por su jubilaci\u00f3n o fallecimiento, salvo que se subrogue su c\u00f3nyuge y contin\u00fae la misma actividad desarrollada en el local. Si por el contrario, quien sucede al arrendatario es su descendiente, entonces el contrato finalizar\u00e1 transcurrido veinte a\u00f1os a contar desde la aprobaci\u00f3n de la Ley, es decir <b>el d\u00eda 1 de enero de 2015<\/b>.<\/li>\n<\/ul>\n<ul>\n<li>Los arrendamientos de locales de negocio cuyo arrendatario fuese <b>una persona jur\u00eddica<\/b> que desarrolle actividades comerciales se extinguen tambi\u00e9n, como regla general, en veinte a\u00f1os a contar desde la aprobaci\u00f3n de la Ley, el 1 de enero de 2015. Las excepciones a esta regla afectan a la duraci\u00f3n del contrato en funci\u00f3n del volumen de negocio de la actividad comercial.<\/li>\n<\/ul>\n<ul>\n<li>En ambos casos, si en los diez a\u00f1os anteriores a dicha entrada en vigor se hubiera producido el traspaso del local de negocio, los plazos de extinci\u00f3n de los contratos se incrementar\u00e1n en cinco a\u00f1os, esto es, hasta 2020.<\/li>\n<\/ul>\n<p>La Ley de 1994 tambi\u00e9n prev\u00e9 el derecho a indemnizaci\u00f3n del arrendatario por una cuant\u00eda igual a dieciocho mensualidades de la renta vigente al tiempo de la extinci\u00f3n del arrendamiento cuando antes del transcurso de un a\u00f1o desde la extinci\u00f3n del mismo, cualquier persona comience a ejercer en el local la misma actividad o una actividad af\u00edn a la que aqu\u00e9l ejercitaba.<\/p>\n<p>Asimismo, el arrendatario guarda un derecho preferente para continuar en el local arrendado si el arrendador pretendiese celebrar un nuevo contrato con distinto arrendatario antes de haber transcurrido un a\u00f1o a contar desde la extinci\u00f3n legal del arrendamiento.<\/p>\n<p>Finalmente, la disposici\u00f3n transitoria tercera de la LAU 1994, prev\u00e9 la posibilidad de incrementar el plazo de duraci\u00f3n, en cinco a\u00f1os m\u00e1s, siempre y cuando el arrendatario en la primera renta que corresponda pagar hubiere procedido a requerimiento del arrendador, o a iniciativa propia, a la actualizaci\u00f3n del 100% de la renta.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n\r\n\t\t<style>\r\n\t\t\t.huge-it-share-buttons
