{"id":1165,"date":"2014-07-08T18:30:47","date_gmt":"2014-07-08T16:30:47","guid":{"rendered":"http:\/\/www.fabregat-perulles-sales.com\/actualidad\/?p=1165"},"modified":"2014-11-26T14:32:32","modified_gmt":"2014-11-26T12:32:32","slug":"progetto-di-legge-sulla-cooperazione-giudiziaria-internazionale-in-materia-civile","status":"publish","type":"post","link":"https:\/\/www.fabregat-perulles-sales.com\/actualidad\/progetto-di-legge-sulla-cooperazione-giudiziaria-internazionale-in-materia-civile\/","title":{"rendered":"PROGETTO DI LEGGE SULLA COOPERAZIONE GIUDIZIARIA INTERNAZIONALE IN MATERIA CIVILE"},"content":{"rendered":"<p>Il Consiglio di Ministri spagnolo ha approvato il <a href=\"http:\/\/http:\/\/noticias.juridicas.com\/actual\/3999-aprobado-el-anteproyecto-de-ley-de-cooperacion-juridica-internacional-en-materia-civil.html\">Progetto di Legge per la cooperazione giudiziaria internazionale<\/a> in materia civile, che si occupa, tra le altre cose, di migliorare gli atti di comunicazione di documenti giudiziali e stragiudiziali, e la pratica e ottenimento di prova, cos\u00ec come modificare <i>l\u2019exequatur<\/i> (il procedimento civile speciale per riconoscere e dare esecuzione alle sentenze straniere).<\/p>\n<p>Per la prima volta in Spagna si prevedono comunicazione giudiziarie dirette, e si stabilisce che, in quei casi in cui non si provi il contenuto e la vigenza dal diritto straniero, si potr\u00e0 applicare il diritto spagnolo.<\/p>\n<p><!--more--><\/p>\n<p>Per quanto riguarda l\u2019<i>exequatur<\/i>, si stabilisce un nuovo disegno che prevede la sussidiariet\u00e0 di questa norma rispetto alla normativa spagnola speciale, i trattati e le convenzioni ratificate in Spagna. Si regola anche il riconoscimento e l\u2019esecuzione delle risoluzioni straniere, cos\u00ec come la procedura giudiziale secondo la dottrina e la giurisprudenza attuali.<\/p>\n<p>Infine i notai e il Registro della propriet\u00e0 dovranno favorire l\u2019esecuzione di documenti pubblici stranieri e l\u2019iscrizione nei registri pubblici, adeguando le istituzioni straniere che possono risultare sconosciute. In questo senso, potranno adattare i documenti pubblici stranieri in cui si ordinano delle misure o si incorporano istituzioni o diritti sconosciuti al diritto spagnolo, a quelle misure previste dal
